近日，海南省新聞辦在?？谡匍_《海南自由貿易港境外人員參加職業資格考試管理辦法（試行）》《海南自由貿易港境外人員執業管理辦法（試行）》（以下統稱“兩個辦法”）新聞發布會，省委組織部、省委人才發展局、省人社廳、省住建廳等部門相關負責人介紹了“兩個辦法”相關情況并接受記者提問。下面重慶西迪斯翻譯公司就用雙語的方式來為大家解讀本次的政策吧！

8月28日，海南省委深改委會議暨自貿港工委會議研究通過了“兩個辦法”，對放寬境外專業人才在海南自由貿易港參加職業資格考試和執業的限制做出了明確制度安排。這是海南貫徹落實習近平總書記關于海南人才工作一系列重要指示批示精神和《海南自由貿易港建設總體方案》人才工作有關精神，在人才政策上實現突破的具體措施；是對標國際領先水平和最高開放形態，實現境外人員在海南自由貿易港就業創業自由化便利化的重要政策舉措。
“兩個辦法”在境外人員參加職業資格考試方面明確提出：
● 凡遵守中華人民共和國法律、法規，恪守職業道德，符合國家或我省職業資格考試規定條件（國籍條件除外）的境外人員，可自愿參加相應職業及級別的職業資格考試；
● 職業資格考試的項目實行目錄清單管理，由省委人才工作部門、省人力資源社會保障部門會同省級相關行業主管部門公布；
● 境外人員在海南自由貿易港參加職業資格考試，與境內考生實行統一考試標準、統一組織考試、統一制發證書；
● 報名參加職業資格考試，按規定提交有關材料，由行業主管部門或考試機構進行資格審查，審查合格的，發放準考證，報考人員按準考證標明的時間和地點參加考試；
● 參加考試應遵守考試紀律和有關規定，對違反考試規定的，按照考試違紀違規行為處理規定處理；
● 境外人員通過考試取得的職業資格證書是表明其從事相應職業所必備的學識和能力的證明，在海南自由貿易港有效（國家已對境外人員開放職業資格考試的，頒發全國統一證書，在全國范圍有效）。
● 今年開放境外人員參加職業資格考試30多項。
在境外人員執業管理方面，明確提出：
● 境外職業資格是指境外機構或組織頒發的所涉職業（工種）關系公共利益或公共安全、人身健康、生命財產安全的職業資格（注冊會計師、法律服務等除外），由省委人才工作部門、省人力資源社會保障部門會同省級相關行業主管部門根據海南自由貿易港建設需要制定認可的境外職業資格目錄清單，并實行動態調整；
● 境外人員以目錄清單內的境外職業資格名義為海南自由貿易港內企業和居民提供專業服務前，須符合條件并通過技能認定，取得《海南自由貿易港境外人員技能認定合格證》；
● 省級行業主管部門是本行業境外人員技能認定的組織實施部門，技能認定方式可采用材料審核、答辯等多種方式進行，境外人員申請技能認定由聘用單位申請、行業主管部門認定發證，《海南自由貿易港境外人員技能認定合格證》是表明境外人員具備在海南自由貿易港內從事相關專業服務的有效憑證等；
● 取得《海南自由貿易港技能認定合格證》的境外人員，在規定的專業服務范圍和有效期限內與省內同類專業人員具有同等權利，提供需要加蓋國內執業印章的專業服務時，由境外人員簽字并加蓋其聘用單位印章，海南自由貿易港內相關主管部門應當予以認可，直接為海南自由貿易港內企業和居民提供專業服務時應遵守相關規定等；
● 行業主管部門負責加強對境外持證人員從事專業服務活動的監督檢查，聘用單位應建立境外人員專業服務信用檔案，境外人員和聘用單位違反本辦法規定的處理措施等。
● 今年認可的境外職業資格涉及20多個國家和港澳臺地區共200多項。
“兩個辦法”的制定實施將有力推動海南建立起國際領先的人才服務管理體制機制，形成公平、包容、自由、便捷的國際人才制度環境，確保各類國際人才引得來、留得住、用得好，深入打造人才對外開放高地，助力海南自由貿易港建設。

Actively Building a New Highland for Opening of Talents to the Outside World
On August 28, 2020, the Free Trade Port Working Committee of the CPC Hainan Provincial Committee approved the Administrative Measures for Overseas Personnel in the Hainan Free Trade Port to Take Professional Qualification Examinations (Trial)and the Administrative Measures for the Practice of Overseas Personnel in the Hainan Free Trade Port (Trial) (hereinafter referred to as “Two Measures”), making explicit institutional arrangements for liberalizing overseas personnel’s participation in professional qualification examinations and practice in the Hainan Free Trade Port. The approval of such Measures is a ground-breaking step on talent policytaken by Hainan for the purpose of implementingPresident Xi Jinping’s major instructions on talent development of Hainan and requirements of the Master Plan for the Construction of the Hainan Free Trade Porton talent development, as well as a major policy to realize the freedom and convenience of overseas personnel’s employment and entrepreneurship in the Hainan Free Trade Port that keeps in line with the leading level in the world and the maximum degree of openness.
Regarding overseas personnel’s participation in professional qualification examinations, the two Measures explicitly provide: All overseas personnel mustcomply withthe laws and regulations of the People’s Republic of China andprofessional ethics as well asmeet the requirements of the State or Hainan Province for professional qualification examinations (except the requirement of nationality) and may voluntarily sign up for taking professional qualification examinations of the corresponding occupation and level; Professional qualification examinations taken by overseas personnel in the Port shall be put under directory list management. The Talents Department of the Provincial Party Committee and Human Resources and Social Security Department of Hainan Province, in conjunction with relevant provincial-level industry authorities, shall make public relevant information. For overseas personnel who takeprofessionalqualification examinations in the Port, unified examination standards shall be implemented, examinations shall be organized, and certificates shall be issuedin a unified way. Overseas personnel shall register for professional qualification examinations, submit relevant materials according to requirements and accept qualification review of the industry or examination authorities; admission tickets will be issued to qualified personnel, who shall attend the examinations at the time and venue indicated on the tickets and comply with examination disciplines and relevant regulations, while personnel violating such disciplines and regulations shall be punished according to the provisions on the handling of violation of disciplines and regulations in examinations. The professional qualification certificates obtained by overseas personnel through examinations are certificates manifesting the personnel’s knowledge and ability necessary for engaging inrelevantprofession and are valid in the Hainan Free Trade Port (where the State has made the professional qualification examination open to overseas personnel, the unified certificate shall be issued throughout the country and valid nationwide). In 2020, over 30 professional qualification examinations will be open to overseas personnel.
Regarding the management of overseas personnel’s practice, the two Measures explicitly provide: Overseas professional qualifications referred to as in these Measures refer to those professional qualifications relating to the public interests or public security, personal health, life and property security of professional/occupations established by overseas governments or institutions (except for certified public accountants, legal services, etc.). According to the construction needs of the Port, the Talents Department of the Provincial Party Committee and Human Resources and Social Security Department of Hainan Province, in conjunction with relevant provincial-level industry authorities, have formulated a list of approved overseas professional qualifications, and implemented dynamic adjustments.Before overseas personnel directly provide relevant professional services enterprises and residents within the Port in the name of overseas professional qualifications within the approved list, they shall meet relevant requirements and pass the skill certification, and obtain the Skill Certification Certificate of Overseas Personnel in the Hainan Free Trade Port. Provincial-level industry authorities shall be responsible for the skill certification of overseas personnel in the relevant industry. The employers shall apply for the skill certification of overseas personnel, and the industry authorities shall certify the skills, by various ways such as material review and defense, and issue certificates accordingly.Overseas personnel holding the Skill Certification Certificate of Overseas Personnel in the Hainan Free Trade Port shall enjoy the same rights as similar professionals in Hainan Province within the scope and terms of professional services as specified. When Overseas Certified Personnel provide professional services to be affixed with the domestic practice seal, the overseas personnel shall sign and affix the seal of their employers, which shall be recognized by the relevant authorities within the Port. When directly providing professional services to enterprises and residents in the Hainan Free Trade Port, overseas personnel shall comply with relevant regulations. The industry authorities shall be responsible for enhancing the supervision and inspection of the provision of professional services of Overseas Certified Personnel, and the employers shall establish credit files for overseas personnel providing professional services. The two Measures also provide punishmentsto overseas personnel and employers violating the regulations. Over 200 overseas professional qualification involving over 20 countries and regions are recognized in 2020.
The formulation and implementation of the two Measures will effectively push forward the establishment of a world-leading management system of talent services as well as a fair, tolerant, free and convenient environment for international talents in Hainan, and in which way promote the introduction, retainment and use of various international talents, build in-depth a highland for opening of talents, and facilitate the construction of the Hainan Free Trade Port.
